Whenever there is a change in the law, any area of the law, all corollary statutes must also be examined and or altered. Difficult to do when it must be done in the short time frame that we provide our legislators. But, it’s something that must be done and considering the search engines that are now available, it’s easier than ever to catch overlapping statutes.
Case in point: the legislature reduced the loss of license time for under aged drinkers, while at the same time, or close to the same time lumping the same drinkers under the Not A Drop statute that was created for previous DUI drinkers. This statute mandates a one year revocation, which may, in fact, be appropriate for a previous DUI Not A Drop, but certainly not for a first time, which normally carries only a 120 day suspension for a DUI conviction!
Legislating is not an easy job, but nevertheless requires precision.
