DUI

WHO SHOULD YOU CALL WHEN THE ODDS ARE AGAINST YOU? The ramifications and punishment for DUI have increased steadily over the years and the legislature annually enhances punishment for DUIs. A second offense within 10 years or a first offense where the blood alcohol is .16 or higher mandates an ignition interlock device, jail time, and formal probation. There are circumstances where a judge can waive these requirements but those circumstances must be stated for the record. A third offense in 10 years can be enhanced to Felony status for which the punishment is 0 to 5 years in the state prison and up to a $5,000.00 fine.

Once you have been charged with a DUI, the prosecuting authority aligns all of it's considerable authority and powers against you. Can you afford an attempt to trek through the maze which the legislature has created in this area without protection and an experienced guild? A DUI is a tough and complex offense to be charged with and you need the best defense for a tough offense.

With all of the new and old consequences of a DUI conviction, including possible loss of license up to twenty-four months, a "Not a Drop Restricted License" for a period of up to ten years, jail or prison time, enormous insurance increases, the requirement of formal probation and an Ignition Interlock Device, you can't afford not to know what you're doing or to do the right thing, when it comes to being charged with a DUI. I've focused my practice on DUI defense since 1987 and have seen the Utah State Legislature further penalize and stigmatize the DUI laws each year since that time. By focusing my work, my ideas and my creativity in this area for the past 18 plus years, I've achieved and created positive solutions to complex problems involving license dependent jobs, long term jail sentences, loss of license, and the penalties associated with DUI accidents.

The results of a DUI conviction can leave lifelong and career altering scars. There are often good defenses to what may otherwise look like tough cases. These may center on incorrect assumptions of the police officer, illegal stops and/or arrests, unreliable tests, mistakes made by or lack of experience on behalf of the police officer, and often unfulfilled requirements of applicable statutes.
